1.1. These Terms & Conditions (the “Terms”) govern the rights and obligations between:

b) the customer (the “Customer”),
when using the FixMistr service, which consists of arranging and coordinating handyman/crafts services performed by independent craftsmen (the “Craftsman”).
1.2. FixMistr acts as an intermediary and coordinator of the Job: it finds a suitable Craftsman, communicates with the Customer, coordinates the Job, and manages the payment process.
1.3. The actual craft work is always performed by a specific Craftsman as an independent party responsible for professional performance in accordance with applicable law.
1.4. These Terms apply to all jobs arranged through FixMistr unless stated otherwise in a specific Offer.
2.1. FixMistr Service – arranging and coordinating a craft Job between the Customer and the Craftsman, including customer support and the payment process.
2.2. Job – the Customer’s request for specific work.
2.3. Offer – the final scope-and-price proposal before work starts, submitted for the Customer’s approval.
2.4. Offer Approval – the Customer’s explicit confirmation (click, email, SMS, or any provable method).
2.5. Price – the price stated in the approved Offer, as adjusted only by pre-approved changes.
2.6. Consumer – an individual acting outside their business or professional activity.
3.1. FixMistr operates a service that connects Customers with independent Craftsmen and coordinates job delivery.
3.2. FixMistr collects payments for the Job and provides customer support.
3.3. FixMistr does not provide any contractual workmanship warranty beyond mandatory legal provisions.
3.4. Liability for workmanship, defects, and statutory defect claims rests with the Craftsman who performed the work, to the extent provided by law.
3.5. FixMistr provides mediation assistance to help resolve complaints and disputes between the Customer and the Craftsman.
4.1. The Customer may submit a request via FixMistr website/app, phone, email, or any other method allowed by FixMistr.
4.2. The Customer must provide true and complete information needed to assess the Job (work description, address, availability, technical conditions, photos if relevant).
4.3. FixMistr may request additional details; if not provided, FixMistr may refuse the request or provide only an indicative estimate.
5.1. Before work starts, the Customer receives a final Offer including at least: scope description, Price (or pricing method), known extra costs, and expected timing.
5.2. Work starts only after explicit Offer Approval by the Customer.
5.3. Without approval, work must not start unless the Customer explicitly requests urgent intervention and is informed in advance how pricing will be calculated.
5.4. Any change of scope or Price after approval requires the Customer’s prior explicit consent.
5.5. If additional work becomes necessary during execution, a change proposal is provided and additional work is performed only after approval.
6.1. The contract between FixMistr and the Customer is formed upon Offer Approval.
6.2. By approving, the Customer confirms they have read and accept these Terms.
6.3. Unless expressly stated otherwise, electronic communication and confirmations are binding if provable.
7.1. Prices are stated in CZK.
7.2. If the Customer is a Consumer, the Price in the Offer is the final price including all taxes and fees (unless expressly stated separately, e.g., materials).
7.3. If the Customer is a business and requires a VAT tax document, FixMistr will attempt to arrange performance by a VAT-registered Craftsman. In such case, the VAT tax document is issued by the VAT payer (the Craftsman) or by a person authorized in writing by the VAT payer; FixMistr will assist.
7.4. The approved Offer Price is binding except for changes approved under Sections 5.4 and 5.5.
7.5. Minimum call-out/diagnostics fee: if required, a minimum fee of CZK 1,000 may apply, disclosed in advance in the Offer or before confirming the appointment.
7.6. The Price may include or separately list ancillary costs (materials, parking, disposal, etc.) if disclosed and approved in advance.
8.1. FixMistr issues the Customer an invoice or other accounting document for payment of the Job Price. If FixMistr is not VAT-registered, this is not a VAT tax document.
8.2. Payment is cashless only: online card payment or bank transfer.
8.3. Cash payments are not accepted.
8.4. Invoice due date is 7 days unless stated otherwise in the Offer or on the invoice.
8.5. FixMistr bank account: 1018124313/5500.
8.6. In case of late payment, FixMistr may charge statutory late-payment interest and lawful recovery costs.

16.1. Workmanship, defects and related damages are always the responsibility of the Craftsman who performed the work, as required by law; FixMistr provides assistance with claims.

19.1. If the Customer is a Consumer, they have rights under applicable consumer protection laws.
19.2. If the contract is concluded remotely, information on the Consumer’s right of withdrawal and exceptions is provided in accordance with law; statutory exceptions may apply for services performed on the Consumer’s explicit request before expiry of the withdrawal period.
19.3. Competent ADR body: Czech Trade Inspection Authority (ČOI).
19.4. The EU ODR platform ended on 20 July 2025; use ADR under Section 19.3 or court proceedings.
